They supplement<br \/>\nthe statutory provisions of \u00a7\u00a7 651a et seq. of the German Civil Code<br \/>\nas well as the information duties under Article 250 EGBGB.<\/p>\n<div class=\"mt-policy-note\">\n<p>      <strong>Tour operator<\/strong><br \/>\nMasry Tours<br \/>\nOwner: Ahmed Abdelrahman<br \/>\nMalm\u00f6er Street 29<br \/>\n10439 Berlin<br \/>\nGermany<br \/>\nE-mail<br \/>\n<a href=\"mailto:info@masrytours.de\">info@masrytours.de<\/a><\/p>\n<\/div>\n<h2>1. Scope and Contractual Basis<\/h2>\n<p><strong>1.1<\/strong> These General Terms and Conditions of Travel and Business<br \/>\napply, insofar as they were validly incorporated into the contract, to all<br \/>\nMasry Tours offers package holidays as a tour operator.<\/p>\n<p><strong>1.2<\/strong> The basis of the contract is the respective<br \/>\nTravel description, the individual travel offer, the booking confirmation,<br \/>\nthe pre-contractual information, the legally required<br \/>\nForm and these General Terms and Conditions of Travel and Business.<\/p>\n<p><strong>1.3<\/strong> Individual agreements, which explicitly between<br \/>\nreceived by the traveller and Masry Tours, shall take precedence over these<br \/>\nGeneral Terms and Conditions of Travel and Business.<\/p>\n<p><strong>1.4<\/strong> So far as Masry Tours expressly only individual<br \/>\nservices or services of other providers, Masry mediates<br \/>\nTours is not a contracting party for the service arranged. The<br \/>\nThe traveller is made clearly aware of the agency\u2019s role as an intermediary before booking<br \/>\nannounced.<\/p>\n<h2>2. Conclusion of the package holiday contract<\/h2>\n<p><strong>2.1<\/strong> By making a booking, the traveller provides Masry Tours with the<br \/>\nConcluding a package holiday contract is binding. The booking can<br \/>\nin particular via the website, by email, by telephone, in writing or<br \/>\nvia a messaging service.<\/p>\n<p><strong>2.2<\/strong> The contract comes into effect upon acceptance by Masry Tours<br \/>\nconcluded. The traveller shall receive, upon or immediately after the conclusion of the contract,<br \/>\na booking confirmation on a durable medium, usually<br \/>\nby email.<\/p>\n<p><strong>2.3<\/strong> If the booking confirmation differs significantly from the<br \/>\nOnce a booking enquiry has been submitted, it is deemed to be a new offer from Masry Tours. A contract<br \/>\nIn this case, it only comes into effect once the traveller has accepted this new offer<br \/>\nexpressly accepts or makes the required payment in response to this offer<br \/>\nprovides.<\/p>\n<p><strong>2.4<\/strong> If a person makes a booking for other travellers<br \/>\nif it does so, it shall only be liable for their contractual obligations if it<br \/>\nhas expressly and separately undertaken this obligation.<\/p>\n<p><strong>2.5<\/strong> The traveller is obliged to comply with the provisions set out in the<br \/>\nThe name, travel dates and other details listed on the booking confirmation<br \/>\nto check immediately and report any obvious errors to Masry Tours without delay<br \/>\nto inform.<\/p>\n<h2>3. Special requests and individual agreements<\/h2>\n<p><strong>3.1<\/strong> Special traveller requests, for example<br \/>\nwith regard to accommodation, catering, room location, transport or<br \/>\nActivities are only binding if they are expressly agreed upon by Masry Tours.<br \/>\nconfirmed in textual form.<\/p>\n<p><strong>3.2<\/strong> Employees of local service providers,<br \/>\nTour guides or other third parties are not authorised to<br \/>\nTravel contract to change independently or binding commitments on behalf of<br \/>\nMasry Tours to undertake, unless they are expressly authorised to do so<br \/>\nwere.<\/p>\n<h2>4. Payment Terms and Insolvency Protection<\/h2>\n<p><strong>4.1<\/strong> Payments towards the travel price are only due,<br \/>\nafter the package travel contract has been concluded and the traveller<br \/>\nthe legally required information about the<br \/>\nInsolvency protection or the security certificate available<br \/>\nwere asked.<\/p>\n<p><strong>4.2<\/strong> The amount and due date of the deposit are set out in the<br \/>\nrespective travel offer and the booking confirmation. An increased<br \/>\nA deposit may be required, particularly for individually designed trips,<br \/>\nSpecial trips or trips with early payments to hotels,<br \/>\nShips, airlines or other service providers agreed<br \/>\nwill be. These will be communicated transparently to the traveller before the conclusion of the contract.<\/p>\n<p><strong>4.3<\/strong> The remaining travel price is to be paid by the<br \/>\nbooking confirmation, due on the specified date, usually no later than<br \/>\n30 days before departure. Travel services and service changes<\/h2>\n<p><strong>5.1<\/strong> Scope and nature of the owed<br \/>\nTravel services arise from the travel description, the individual<br \/>\nTravel offer, the booking confirmation and the expressly agreed<br \/>\nAdditional benefits.<\/p>\n<p><strong>5.2<\/strong> Masry Tours can make minor<br \/>\nmake changes to individual travel services, if necessary,<br \/>\nreasonable for the traveller and not brought about in bad faith<br \/>\nand the overall character of the booked trip is not affected.<\/p>\n<p><strong>5.3<\/strong> The traveller becomes aware of a change,<br \/>\ncomprehensible and promptly on a durable data carrier<br \/>\ninformed.<\/p>\n<p><strong>5.4<\/strong> In a significant change of essential<br \/>\nStatutory provisions apply to travel services. Masry Tours can the<br \/>\ntravellers in particular a corresponding contract amendment or a<br \/>\nOffer an alternative trip. The traveller can accept the offer or within<br \/>\nwithdraw from the contract free of charge within the stated reasonable period.<\/p>\n<h2>6. Changes to the holiday price<\/h2>\n<p><strong>6.1<\/strong> Masry Tours reserves the right after conclusion of contract<br \/>\nthe following increase in the travel price exclusively within the statutory<br \/>\npermissible scope when<\/p>\n<ul>\n<li>the cost of transporting people due to higher fuel or energy costs,<\/li>\n<li>Taxes, duties, or charges for agreed travel services or<\/li>\n<li>exchange rates relevant for the trip<\/li>\n<\/ul>\n<p>after contract conclusion.<\/p>\n<p><strong>6.2<\/strong> a price increase becomes clear to the traveller,<br \/>\nunderstandable and communicated on a durable medium. The<br \/>\nThe notification contains the reason and a comprehensible calculation of the<br \/>\nIncrease. A price increase is only effective if it is at least 20 days<br \/>\ninformed before the start of the journey.<\/p>\n<p><strong>6.3<\/strong> Do the costs mentioned in point 6.1 decrease<br \/>\nafter conclusion of the contract and before commencement of the journey, the traveller can<br \/>\ndemand a corresponding reduction in the travel price. Masry Tours may<br \/>\nactual administrative costs incurred from the reimbursement amount<br \/>\ndeduct and will provide these upon request.<\/p>\n<p><strong>6.4<\/strong> Does a proposed price increase exceed eight percent<br \/>\nof the agreed travel price, Masry Tours cannot unilaterally<br \/>\nproceed. The traveller can accept the offer or within the<br \/>\nwithdraw from the contract free of charge within a communicated reasonable period.<\/p>\n<h2>7. Withdrawal and Cancellation by the Traveller<\/h2>\n<p><strong>7.1<\/strong> The traveller can at any time before the start of the journey<br \/>\nHoliday package contract withdrawal. The notice of withdrawal should be from<br \/>\ngrounds for evidence in text form, for example by e-mail.<br \/>\nThe determining factor is the time at which the declaration is received by Masry Tours<br \/>\narrives.<\/p>\n<p><strong>7.2<\/strong> If the traveller withdraws before the start of the journey, they lose<br \/>\nMasry Tours retains the right to the travel price, but may demand a reasonable<br \/>\nClaim for compensation under Section 651h of the German Civil Code (BGB).<\/p>\n<p><strong>7.3<\/strong> disclosed prior to the conclusion of the contract and in the<br \/>\nThe booking includes compensation and cancellation rates in the<br \/>\nseparate<br \/>\n<a href=\"\/en\/cancellation-policy-refund-policy\/\"><br \/>\nCancellation, booking amendment, and refund policy<br \/>\n<\/a><br \/>\nregulated. For special trips, events, cruises or trips with<br \/>\nExceptional advance payments may have separate cancellation rates<br \/>\nunless this has been agreed upon with the traveller before the conclusion of the contract<br \/>\nwas informed.<\/p>\n<p><strong>7.4<\/strong> The traveller is permitted to prove that<br \/>\nMasry Tours no damage or significantly less damage than the<br \/>\ncompensation was incurred.<\/p>\n<p><strong>7.5<\/strong> Masry Tours can, instead of an agreed<br \/>\nCancellation fee, the actual reasonable compensation incurred<br \/>\ncalculate. This will include saved expenses as well as any other<br \/>\nUse of the travel services taken into account. The calculation will be provided to the<br \/>\nExplained to travellers upon request.<\/p>\n<p><strong>7.6<\/strong> No compensation will be claimed if<br \/>\nDestination or unavoidable in its immediate vicinity,<br \/>\nexceptional circumstances arise that make it impossible to carry out<br \/>\nPackage holiday or the carriage of passengers to the destination<br \/>\nsignificantly impair.<\/p>\n<h2>8. Contract transfer and rebooking<\/h2>\n<p><strong>8.1<\/strong> The traveller may, within a reasonable period<br \/>\nbefore departure on a permanent storage medium explain that at its<br \/>\nThird party in the rights and obligations from the<br \/>\nPackage travel contract enters into force. Rebookings are possible by agreement<br \/>\nand reimbursed for the actual additional costs incurred<br \/>\nbecome.<\/p>\n<h2>9. Withdrawal by Masry Tours<\/h2>\n<p><strong>9.1<\/strong> Masry Tours can withdraw from the contract before the start of the trip<br \/>\nwithdraw when the travel description or booking confirmation<br \/>\nthe explicitly stated minimum number of participants is not reached.<\/p>\n<p>The notice of cancellation must be received by the traveller no later than:<\/p>\n<ul>\n<li>20 days before the start of the trip for a trip duration of more than six days,<\/li>\n<li>seven days before the start of the trip for a trip duration of at least two and no more than six days,<\/li>\n<li>48 hours before the start of the trip, if the trip lasts less than two days.<\/li>\n<\/ul>\n<p><strong>9.2<\/strong> Masry Tours may also withdraw from the contract before the start of the trip<br \/>\nwithdraw if Masry Tours, due to unavoidable,<br \/>\nprevented from fulfilling the contract by extraordinary circumstances<br \/>\nand the traveller is notified of the cancellation without delay.<\/p>\n<p><strong>9.3<\/strong> In the event of withdrawal by Masry Tours, the following will be lost:<br \/>\nMasry Tours is entitled to the agreed tour price. Already<br \/>\nPayments made will be processed immediately, or at the latest within<br \/>\nRefunded 14 days after cancellation.<\/p>\n<h2>10. No general right of withdrawal for distance bookings<\/h2>\n<div class=\"mt-policy-note\">\n<p>      In the case of package holiday contracts concluded exclusively via the website, by<br \/>\ncan be completed by email, telephone or instant messaging, there is<br \/>\nIn principle, there is no statutory 14-day right of withdrawal. The traveller<br \/>\nhowever, at any time before departure, according to the statutory<br \/>\nCancellation policies and the agreed terms and conditions of cancellation from<br \/>\nWithdraw from the contract.<\/p>\n<\/div>\n<p>A statutory right of withdrawal may exceptionally exist if a<br \/>\npackage travel contract was concluded outside of business premises and<br \/>\nthe oral contract negotiations not on a prior order<br \/>\nor at the invitation of the consumer.<\/p>\n<h2>11. Pass, Visa, Entry and Health Regulations<\/h2>\n<p><strong>11.1<\/strong> Masry Tours informs the traveller in advance of<br \/>\nConclusion of contract regarding the general passport and visa requirements of<br \/>\nCountry of destination, including approximate deadlines for obtaining<br \/>\nrequired visa as well as essential health regulations<br \/>\nFormalities.<\/p>\n<p><strong>11.2<\/strong> The traveller is responsible for ensuring that they and<br \/>\nthe people registered by him the ones necessary for the journey<br \/>\nPossess travel documents and all applicable individual entry,<br \/>\nComply with stay, customs, visa and health regulations.<\/p>\n<p><strong>11.3<\/strong> Special personal circumstances, particularly a<br \/>\nother nationality, dual nationality, missing<br \/>\nRight of residence, health restrictions, or taking<br \/>\nminors, Masry Tours must be informed in good time, subject to<br \/>\nrelevant for travel arrangements.<\/p>\n<p><strong>11.4<\/strong> Disadvantages and costs that arise from missing or<br \/>\ninsufficient travel documents, the traveller is responsible, provided that<br \/>\nMasry Tours the cause not through culpable false or<br \/>\nA non-information set has been set.<\/p>\n<h2>12. Traveler's Rights in Case of Travel Defects<\/h2>\n<p>If the package holiday is defective, the traveller is entitled to<br \/>\nlegal requirements, in particular the following rights:<\/p>\n<ul>\n<li>Demand for remedy,<\/li>\n<li>Self-help and reimbursement of necessary expenses,<\/li>\n<li>Provision of adequate replacement services,<\/li>\n<li>Reduction of the travel price,<\/li>\n<li>Termination of the contract due to significant impairment,<\/li>\n<li>Damages and reimbursement of wasted expenditure.<\/li>\n<\/ul>\n<p>A termination due to a significant travel defect is fundamentally only<br \/>\npermissible, after Masry Tours has been given a reasonable period to remedy<br \/>\nhat und diese erfolglos abgelaufen ist. Liability<\/h2>\n<p><strong>14.1<\/strong> Masry Tours is liable for the proper provision of<br \/>\nthe contractually agreed travel services according to the legal<br \/>\nProvisions of Package Travel Law.<\/p>\n<p><strong>14.2<\/strong> Liability for damage that is not personal injury<br \/>\nand which were not caused through fault, will be multiplied by three<br \/>\nTravel price limited.<\/p>\n<p><strong>14.3<\/strong> Disclaimers or limitations of liability<br \/>\ndue to international agreements or based on such agreements<br \/>\nbased on statutory provisions in favour of a service provider<br \/>\nto the extent legally permissible also in favour of Masry Tours.<\/p>\n<p><strong>14.4<\/strong> liability for damages arising from the breach of<br \/>\nlife, body or health, as well as for intentional or grossly<br \/>\nDamage caused through negligence remains unlimited.<\/p>\n<p><strong>14.5<\/strong> For explicitly designated as external services<br \/>\nand solely brokered services, Masry Tours is not liable as<br \/>\nTour operator. Liability arising from the agency agreement or from<br \/>\nremains unaffected by its own breaches of duty.<\/p>\n<p><strong>14.6<\/strong> Compensation or reimbursement payments that the<br \/>\nPassengers due to the same event on account of passenger or<br \/>\npassenger rights or directly from a service provider<br \/>\nis received, shall be applied to claims against to the extent provided by law<br \/>\nMasry Tours credited.<\/p>\n<h2>15. Unavoidable, exceptional circumstances and assistance<\/h2>\n<p><strong>15.1<\/strong> Unavoidable, exceptional circumstances are<br \/>\nevents outside the control of the party on whom it relies and<br \/>\nthe consequences of which could not have been avoided even if all<br \/>\nreasonable precautions had been taken.<\/p>\n<p>This can include, for example, considerable<br \/>\nSecurity issues, natural disasters, severe epidemics,<br \/>\nofficial travel restrictions or similar events.<\/p>\n<p><strong>15.2<\/strong> Does the traveller during the trip get into<br \/>\nIf difficulties arise, Masry Tours will immediately provide appropriate assistance,<br \/>\nspecifically through information on health services, authorities, or<br \/>\nconsular assistance as well as by assistance in the production<br \/>\nof telecommunications links and the search for alternatives<br \/>\nTravel options.<\/p>\n<p><strong>15.3<\/strong> Did the traveller cause the difficulties deliberately<br \/>\nor negligently self-inflicted, Masry Tours can compensate for the actual<br \/>\ndemand reasonable compensation for expenses incurred.<\/p>\n<h2>16. Statute of limitations and data protection<\/h2>\n<p><strong>16.1<\/strong> Traveller's claims for travel defects according to<br \/>\n\u00a7 651i paragraph 3 of the German Civil Code (BGB) generally become time-barred after two years.<br \/>\nThe limitation period begins on the day the package holiday was transferred to the consumer<br \/>\nshould end.<\/p>\n<p><strong>16.2<\/strong> The respective provisions apply to other claims<br \/>\nstatutory limitation periods.<\/p>\n<p><strong>16.3<\/strong> Personal data will only be processed in accordance with<br \/>\nin accordance with the applicable data protection regulations. Applicable Law, Jurisdiction and Final Provisions<\/h2>\n<p><strong>18.1<\/strong> German law shall apply to the contractual relationship<br \/>\nApplication.
